1. Agreement to Terms
This Driver Agreement ("Agreement") is a contract between you and AkomaExpress that governs your participation as a driver on our platform. By accepting this agreement, you agree to be bound by these terms and conditions.
2. Driver Requirements
To be eligible as a driver, you must:
- Be at least 18 years of age
- Have a valid driver's license
- Have a clean driving record
- Own or have access to a reliable vehicle
- Have valid auto insurance
- Pass a background check
- Complete our driver onboarding process
3. Driver Responsibilities
As a driver, you agree to:
- Maintain a professional appearance and demeanor
- Keep your vehicle clean and well-maintained
- Follow all traffic laws and safety regulations
- Provide excellent customer service
- Handle orders and deliveries with care
- Maintain accurate delivery records
- Report any issues or incidents promptly
4. Vehicle Requirements
Your vehicle must meet the following standards:
- Be in good mechanical condition
- Have adequate space for deliveries
- Display proper registration and inspection stickers
- Have functioning air conditioning and heating
- Be equipped with safety features (seatbelts, airbags)
- Maintain cleanliness and professional appearance
5. Insurance and Liability
You must maintain valid auto insurance that covers commercial use and meets minimum coverage requirements. You are responsible for any damages, injuries, or losses that occur while providing services on our platform.
6. Earnings and Payments
Driver earnings are calculated based on:
- Base delivery fees
- Distance traveled
- Time spent on deliveries
- Customer tips and bonuses
- Performance incentives
Payments are processed weekly, and you are responsible for reporting your earnings for tax purposes.
7. Scheduling and Availability
You have the flexibility to set your own schedule, but you agree to:
- Maintain reasonable availability during peak hours
- Update your status when going online/offline
- Respond promptly to delivery requests
- Provide advance notice for extended absences
8. Customer Service Standards
You must maintain high customer service standards:
- Greet customers professionally
- Handle orders with care and attention
- Communicate clearly about delivery status
- Resolve customer concerns promptly
- Maintain a positive attitude
9. Safety and Security
Your safety and the safety of others is paramount:
- Never drive under the influence of drugs or alcohol
- Take regular breaks to avoid fatigue
- Use hands-free devices for phone calls
- Report any safety concerns immediately
- Follow emergency procedures when necessary
10. Prohibited Activities
You agree not to:
- Accept cash payments outside the platform
- Subcontract or assign deliveries to others
- Use the platform for illegal activities
- Harass or discriminate against customers
- Share confidential customer information
- Manipulate the platform for unfair advantage
11. Termination
This agreement may be terminated by either party:
- Immediately for violations of this agreement
- With 30 days written notice for other reasons
- Upon mutual agreement
Upon termination, you must return any platform equipment and cease using our services.
12. Independent Contractor Status
You are an independent contractor, not an employee of AkomaExpress. You are responsible for your own taxes, insurance, and business expenses. We do not provide benefits, workers' compensation, or unemployment insurance.
13. Dispute Resolution
Any disputes arising from this agreement will be resolved through binding arbitration in accordance with our dispute resolution procedures. You waive your right to a jury trial or class action lawsuit.
14. Changes to Agreement
We may modify this agreement at any time. We will notify you of material changes, and continued use of the platform constitutes acceptance of the modified terms.
